In accordance with the provisions of the Federal Law on the Protection of Personal Data Held by Private Parties (LFPDPPP), we hereby inform you that T&C Group*, located at Ángel Urraza 625, Colonia Del Valle, C.P. 03100, Mexico City, Mexico; in the event of collecting your personal data, is responsible for the use, security, and confidentiality that will be given to them.

I Purpose of Requesting Your Personal Data

The purposes for which we collect and use your personal data are:

  • Recruitment and selection of candidates for a vacant position or to include them in our prospect database.
  • Participation in conventions, meetings, congresses, and events organized by our clients.
  • Censuses and statistics requested by our clients.
  • Fulfillment of obligations contracted with our clients.
  • To follow up when using the suggestion and complaint mailbox.
  • Perform any present or past labor management.
  • Process payment of invoices to suppliers for the purchase of goods and/or services.
  • For the issuance of tickets, visa processing, and booking accommodations.

II Means to Collect Personal Data for the Purposes Stated

We may collect your Personal Data through different means:

  • By using emails.
  • When you provide them directly to us.
  • When you communicate with us via telephone (including customer service centers).
  • Through short text messages (SMS).
  • When you visit our website or use our online services.
  • Through the use of automatic data capture tools.
  • From public access sources and other sources permitted by law, such as telephone directories.

III Personal Data Requested

  • The personal data required will be destined to comply with applicable legislation, as well as with requirements from federal and local authorities, depending on the services requested, complying with the principles set forth in Article 6 of the LFPDPPP.

IV ARCO Rights (Access, Rectify, Cancel, and Oppose)

  • You have the right to Access your personal data that we hold and the details of their treatment, as well as to Rectify them if they are inaccurate or incomplete; Cancel them when you consider that they are not required for any of the purposes indicated in this privacy notice, are being used for purposes not consented to, or the contractual or service relationship has ended, or else Oppose the treatment of them for specific purposes. This is detailed in Chapter 4 of the LFPDPPP.

V Responsible for Personal Data

We have designated a privacy contact as responsible for the custody of Personal Data, who will process requests and promote the protection of Personal Data within the company. The contact information is as follows:

VI How to Exercise Your ARCO Rights

The mechanisms implemented to exercise these rights involve submitting a request that must contain at least the following:

  • Full name and address of the owner of the Personal Data, or another means to communicate the response to their request.
  • Documents proving the identity or legal representation of the owner of the Personal Data.
  • Clear and precise description of the Personal Data regarding which one of the aforementioned rights is sought to be exercised.
  • Any other element or document facilitating the location of the Personal Data.
  • Specify the modifications to be made and/or the limitations on the use of the Personal Data.
  • Provide documentation supporting your request.

We commit to informing the owner of the Personal Data of the determination made, within a period not exceeding 20 business days from the date the request was received. This period may be extended once for an equal period, provided that the circumstances of the case justify it.

Based on the above, and in accordance with the provisions of the LFPDPPP, we will inform the owner of the Personal Data of the sense and motivation of the resolution, through the same means by which the request was made, and the relevant evidence will be attached to said resolution, if applicable.

When the request is deemed appropriate, it will be fulfilled within 15 business days following the communication of the adopted resolution to the owner.

The owner has the right to file a data protection request with the Federal Institute of Access to Information (IFAI) regarding the response received or, if applicable, due to our failure to respond. This request must be submitted by the owner within 15 business days following the date on which the response to the owner is communicated by us, and will be subject to the provisions of the LFPDPPP.

In case of requests for access to Personal Data, it will be necessary for the applicant or their legal representative to previously prove their identity.

The obligation to provide access to information will be considered fulfilled when we make the Personal Data available to the owner or by issuing simple copies or electronic documents.

If a person requests access to their Personal Data presuming that we are the responsible party and it turns out that we are not, it will be sufficient for us to inform the owner of this by any means (established in this section) to consider the request as resolved.

We may deny total or partial access to Personal Data or the carrying out of rectification, cancellation, or opposition to the treatment thereof, in the following cases:

  • When the requester is not the owner or the legal representative is not accredited for it.
  • When the Personal Data of the requester is not found in our Database.
  • When the rights of a third party are violated.
  • When there is a legal impediment or a resolution of an authority.
  • When the rectification, cancellation, or opposition has been previously carried out, so that the request lacks substance.

VII Data Transfer

In the event that we transfer your Personal Data to any of our clients for the purposes of processing established in this Privacy Notice, it will be done after the signing of confidentiality agreements, provided that the client or person to whom they are transmitted agrees to submit the treatment of the Personal Data to the conditions of this Privacy Notice. If you do not express your opposition to your Personal Data being transferred to third parties, it will be understood that you have given your consent for this. We commit not to transfer your personal information to third parties without your consent, except for the exceptions provided in Article 37 of the LFPDPPP.

VIII Social Networks

Social networks constitute a communication platform and interconnection between digital platforms of different users, so they are unrelated to T&C Group and, therefore, are not under our responsibility. The information provided within social networks in which T&C Group participates as a user does not constitute, nor is part of, Personal Data subject to the protection of this Privacy Notice, being the responsibility of the company providing that platform and the one that publishes it.

IX Use of Cookies

The provider on its own behalf or that of a third party contracted to provide measurement services may use cookies when a user browses the website. Cookies are files sent to the browser by a web server with the purpose of recording the user’s activities during their browsing time.

The cookies used by the website are associated solely with an anonymous user and their computer, and do not provide the user’s personal data by themselves.

By using cookies, it is possible for the server where the website is located to recognize the web browser used by the user in order to make browsing easier, allowing, for example, access to users who have previously registered, access to areas, services, promotions, or contests reserved exclusively for them without having to register on each visit. They are also used to measure audience and traffic parameters, control progress, and the number of entries.

The user has the possibility to configure their browser to be notified of the receipt of cookies and to prevent their installation on their device. Please refer to your browser’s instructions and manuals for more information.

To use the website, it is not necessary for the user to allow the installation of cookies sent by the website, or the third party acting on its behalf, without prejudice to the fact that it may be necessary for the user to log in to each of the services whose provision requires prior registration or login.

The cookies used on this website are, in any case, temporary with the sole purpose of making their subsequent transmission more effective. Under no circumstances will cookies be used to collect personal information.

X IP addresses

The servers of the website may automatically detect the IP address and domain name used by the user. An IP address is a number automatically assigned to a computer when it connects to the Internet. All this information is recorded in a duly registered server activity file that allows the subsequent processing of the data in order to obtain only statistical measurements that allow knowing the number of page impressions, the number of visits made to web services, the order of visits, the access point, etc.

XI Changes in the Privacy Notice

We reserve the right to make modifications or updates to this Privacy Notice at any time, to address legislative reforms, internal policies, or new requirements for the provision or offering of our services or products. These modifications will be made available to the public through announcements, brochures, or visible leaflets in our establishments or service centers, on our website, or will be sent to the last email address provided by you. XII Data Protection Measures

T&C Group has established and maintains administrative, technical, and physical security measures that allow protecting the personal data collected against damage, loss, alteration, destruction, or unauthorized use, access, or treatment, which are the same as those used for the storage and processing of our information.

In the event that security breaches occurring at any stage of the treatment significantly affect the patrimonial or moral rights of the owners, they will be immediately notified to the owner, so that the latter can take appropriate measures to defend their rights.

XIII Final Consideration

he content of this Privacy Notice is informative, so if you wish to express your acceptance or rejection of its content, we invite you to send the corresponding request directly to the person responsible for the Personal Data indicated in section V of this document.

Likewise, if you believe that your right to the protection of personal data has been violated by any conduct of our employees or our actions or responses, or if you suspect that there is a violation of the provisions of the LFPDPPP in the processing of your personal data, do not hesitate to contact our Data Protection Officer who will address your complaint and provide a timely response to its resolution, in accordance with sections V and VI of this document.
